TERMS OF SERVICE

Last Updated: September 13, 2026

These Terms of Use (“Terms”) govern your access to and use of www.ablepam.ca (the “Website”), operated by AblePam Inc., operating as AblePam Homecare (“AblePam Homecare,” “AblePam,” “we,” “us,” or “our”).

By accessing or using this Website, you agree to these Terms. If you do not agree with these Terms, please discontinue use of the Website.

These Terms apply primarily to your use of our Website. The provision of homecare services is subject to separate service arrangements, including applicable intake documents, care plans, consent forms, service agreements, policies, rates, and other terms agreed upon between AblePam Homecare and the client or the client’s authorized representative.

1. ABOUT ABLEPAM HOMECARE

AblePam Homecare provides non-medical in-home support services for children with special needs and seniors in the communities we serve.

Depending on the needs of the client and the services agreed upon, our services may include:

  • In-home respite and caregiver relief;
  • Companionship and supervision;
  • Assistance with personal care and daily routines;
  • Support with meals and mealtime routines;
  • Recreational and engagement activities;
  • Light housekeeping and laundry;
  • Overnight support;
  • Home sitting; and
  • Other agreed non-medical assistance with activities of daily living.

The specific services provided to each client will be determined through our intake and service-planning process.

2. NON-MEDICAL NATURE OF OUR SERVICES

Unless expressly agreed otherwise in writing and provided by an appropriately qualified professional, AblePam Homecare provides non-medical support services.

Information provided through this Website is for general informational purposes and is not medical, nursing, psychological, therapeutic, legal, or other professional advice.

Our caregivers do not diagnose medical conditions or provide medical treatment simply by virtue of providing homecare services.

Where medication support is offered as a medication reminder, this means reminding or prompting a client to take medication according to an established routine. It should not be interpreted as medication prescribing or other regulated medical services.

If a client requires services beyond our scope, AblePam may recommend that the client or family seek assistance from an appropriate healthcare professional or service provider.

3. NOT AN EMERGENCY SERVICE

AblePam Homecare is not an emergency medical service.

Do not use this Website, email, voicemail, or other AblePam communication channels to obtain emergency assistance.

If you believe that you or another person is experiencing a medical or other immediate emergency, call 911 or the appropriate emergency service immediately.

4. WEBSITE INFORMATION

We make reasonable efforts to ensure that information on our Website is accurate and current. However, information may occasionally contain errors, omissions, or outdated information.

Information about our services, service areas, caregiver availability, pricing, programs, policies, and other matters may change from time to time.

Nothing on the Website guarantees that a particular service, caregiver, schedule, or service location will be available.

Contacting us or completing an inquiry or intake form does not automatically create a client-care relationship or guarantee that AblePam will accept a request for services.

5. CHILDREN AND CLIENTS WITH AUTHORIZED REPRESENTATIVES

Our services may be provided to children, including children with special needs. However, contractual arrangements for services for a child must be made by the child’s parent, legal guardian, or another person legally authorized to act on the child’s behalf, as applicable.

Where an adult client has an authorized substitute decision-maker or other legally authorized representative, that person may participate in service arrangements as permitted by applicable law.

We encourage the involvement, preferences, dignity, and appropriate assent of the person receiving care whenever reasonably possible.

6. SERVICE INQUIRIES AND INTAKE

Information submitted through the Website, telephone, email, or our intake process may be used to:

  • Respond to inquiries;
  • Determine whether our services may be appropriate;
  • Arrange consultations or assessments;
  • Develop an appropriate service plan;
  • Schedule services;
  • Communicate with clients and families; and
  • Administer our business and services.

Clients and their authorized representatives are responsible for providing information that is accurate and reasonably complete, particularly information that may affect the health or safety of the client or caregiver.

Important information may include allergies, medical conditions, behavioural or safety concerns, mobility limitations, communication needs, emergency procedures, environmental hazards, and other relevant support needs.

7. CLIENT SERVICE AGREEMENTS

These Website Terms do not replace a Client Service Agreement or other documents governing the delivery of care.

Before or during the commencement of services, clients or their authorized representatives may be required to review, complete, or sign documents addressing matters such as:

  • Services to be provided;
  • Service schedules;
  • Rates and payment;
  • Cancellation and rescheduling;
  • Care or support plans;
  • Emergency procedures;
  • Consent;
  • Transportation, where applicable;
  • Privacy and information sharing;
  • Client and caregiver responsibilities;
  • Home safety;
  • Service changes; and
  • Suspension or termination of services.

If there is a conflict between these Website Terms and a signed Client Service Agreement concerning the actual provision of homecare services, the Client Service Agreement will govern that service relationship, to the extent of the conflict.

8. CAREGIVER AVAILABILITY

We make reasonable efforts to provide reliable and consistent services. However, we cannot guarantee the availability of a particular caregiver.

Caregiver availability may be affected by illness, emergencies, scheduling changes, weather, transportation issues, staffing availability, or other circumstances.

Where reasonably possible, we may offer an alternative caregiver or schedule when the originally scheduled caregiver is unavailable.

Any specific scheduling and cancellation requirements will be addressed through the applicable Client Service Agreement and AblePam policies.

9. HOME AND SERVICE ENVIRONMENT

Clients and families are expected to provide a reasonably safe environment for services.

AblePam may decline, suspend, modify, or terminate services where we reasonably believe that the environment presents a significant health or safety risk to the client, caregiver, or another person.

This may include circumstances involving undisclosed hazards, violence, harassment, abuse, unsafe animals, dangerous substances, serious infection risks, or other conditions that cannot reasonably be managed.

10. RESPECTFUL CONDUCT

AblePam is committed to respectful and dignified care.

Clients, family members, caregivers, employees, contractors, and representatives are expected to treat one another with dignity and respect.

Harassment, threats, violence, discrimination, abuse, exploitation, or other seriously inappropriate conduct will not be tolerated and may result in services being suspended or terminated, subject to applicable law and contractual obligations.

11. PRIVACY

Your privacy is important to us.

Personal information submitted through our Website or collected in connection with our services will be handled in accordance with our Privacy Policy, applicable privacy requirements, and our internal privacy and confidentiality practices.

Our Privacy Policy is available on the AblePam Homecare Website.

Please do not submit highly sensitive personal or health information through general website forms or ordinary email unless requested or an appropriate method has been provided.

12. WEBSITE USE

You agree to use this Website only for lawful purposes.

You must not:

  • Attempt to gain unauthorized access to the Website, servers, systems, or data;
  • Introduce malware, viruses, or harmful code;
  • Interfere with the operation or security of the Website;
  • Use automated systems to improperly scrape, copy, or disrupt the Website;
  • Impersonate another person;
  • Submit false, fraudulent, misleading, threatening, or unlawful information;
  • Use the Website to harass or harm another person; or
  • Use Website content in a manner that infringes our rights or the rights of others.

We may restrict or terminate access to the Website where we reasonably believe these Terms have been violated.

13. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Website and its original content—including text, graphics, logos, branding, designs, documents, photographs, and other materials—are owned by or licensed to AblePam and are protected by applicable intellectual property laws.

You may view and print reasonable portions of the Website for your personal, non-commercial use.

You may not reproduce, distribute, sell, modify, republish, commercially exploit, or create derivative works from our Website content without our prior written permission, except where permitted by law.

14. THIRD-PARTY LINKS

Our Website may contain links to websites, resources, or services operated by third parties.

These links may be provided for convenience or informational purposes. AblePam does not necessarily control or endorse third-party websites and is not responsible for their content, privacy practices, availability, products, or services.

Your use of third-party websites is subject to their own terms and policies.

15. TESTIMONIALS AND REVIEWS

Testimonials or reviews appearing on our Website or social media may reflect the individual experiences of particular clients or families.

Individual experiences vary. Testimonials should not be interpreted as a guarantee that another client will have the same experience or outcome.

Where we publish identifiable client information, photographs, videos, or testimonials, we will seek appropriate authorization where required.

16. WEBSITE AVAILABILITY

We may modify, update, suspend, discontinue, or restrict any part of the Website from time to time.

We do not guarantee that the Website will always be available, uninterrupted, secure, or free from technical errors.

We may also correct errors or update information without prior notice.

17. DISCLAIMER

To the extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.

We make reasonable efforts to provide useful and accurate information but do not warrant that all Website information will always be complete, current, error-free, or suitable for every individual circumstance.

Nothing in these Terms excludes any warranty, condition, right, or remedy that cannot lawfully be excluded under applicable law.

18. LIMITATION OF LIABILITY

To the extent permitted by applicable law, AblePam Inc., AblePam Homecare, and their directors, officers, employees, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from the use of, or inability to use, this Website.

Nothing in these Terms is intended to exclude or limit liability where such liability cannot legally be excluded or limited.

This limitation applies to Website use. Liability relating to the actual provision of homecare services should be addressed separately in the applicable Client Service Agreement and in accordance with Ontario law.

19. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold AblePam harmless from third-party claims, losses, liabilities, or reasonable expenses arising from your unlawful use of the Website, your material violation of these Terms, or your infringement of another person’s rights.

This provision does not require you to indemnify AblePam for AblePam’s own negligence or misconduct where such an obligation would be prohibited by law.

20. GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Subject to any rights or procedures that cannot lawfully be excluded, disputes relating to these Website Terms will be subject to the jurisdiction of the courts of Ontario.

21. DISPUTE RESOLUTION

If a concern or dispute arises regarding the Website or these Terms, we encourage you to contact us first so that we can attempt to resolve the matter in good faith.

Nothing in this section prevents either party from seeking urgent legal relief where appropriate or exercising rights or remedies available under applicable law.

22. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our Website, business, services, or applicable requirements.

When we make changes, we will update the “Last Updated” date at the top of this page.

Your continued use of the Website after updated Terms are posted constitutes acceptance of those Terms to the extent permitted by law.

Material changes affecting an existing client service relationship will be handled in accordance with the applicable Client Service Agreement and applicable law rather than relying solely on changes to these Website Terms.

23. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

24. ENTIRE AGREEMENT FOR WEBSITE USE

These Terms, together with our Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and AblePam regarding your use of this Website.

They do not constitute the complete agreement governing homecare services provided to a client.
